Indiana laws and handbook points

Points from Indiana law and the Indiana driver handbook, each taken from one of our Indiana practice questions with its source. Practice material, not the state test.

  • Permits and graduated licensing

You are 16, have not taken driver education, and want a learner's permit. What do you need?

Answer: Documents, a vision test and a passed exam. At 16, a learner's permit needs documents, a vision screening and a passed knowledge exam. Driver education enrollment is required only at age 15.

Other choices: Six months of logged supervised practice first. Logged practice is a license requirement and cannot be earned before holding a permit. A road test with a BMV examiner. The skills exam comes later, for the license, and is not part of getting a permit.

  • Alcohol and drugs

Which situation is an Indiana open-container violation?

Answer: A half-empty bottle of wine on the front seat. An opened alcohol container in the passenger area breaks the law. A locked console or a trunk is the legal place to carry it.

Other choices: An opened bottle held by a passenger in a licensed taxi. Passengers in vehicles for hire are covered by an exception. A sealed bottle of wine on the back seat. A sealed, unopened bottle does not violate the open-container law.

Sources: IC 9-30-15-3; Driver handbook, Chapter 8: Impaired Driving.

  • Insurance

You toss a fast-food bag out your window onto the roadside. What might happen?

Answer: You can be cited for littering. Leaving refuse outside a container on the roadside or others' property is littering, and litter thrown from a moving vehicle is presumed to be the driver's act.

Other choices: Nothing, because the bag is biodegradable. Material type does not make littering legal. A criminal felony charge. A bag is not a felony level offense.

Sources: IC 35-45-3-2; Driver handbook, Chapter 7: Safe Vehicle Operation.

  • Speed and following distance

You follow a car on a dry road. The car passes a sign and you reach it one second later. What should you do?

Answer: Drop back to leave at least two to three seconds. Leave a gap of two to three seconds behind the car ahead. Pick a fixed object and count the seconds between the two vehicles passing it.

Other choices: Match the car's brake lights with yours. Waiting for brake lights leaves no gap to stop. Move closer to see better. Closing in reduces your reaction time.

Sources: IC 9-21-8-14; Driver handbook, Chapter 7: Safe Vehicle Operation.

  • Parking

On a street with a curb, a parked car must have its wheels how close to the curb?

Answer: Within 12 inches. A vehicle parked at a curb must be parallel to it with the right-hand wheels within 12 inches. Parking farther out leaves the car sticking into the travel lane.

Other choices: Within 5 feet. Five feet would leave the car sticking far out into the travel lane of the road. Within 30 inches. Thirty inches leaves too much of the car in the lane.

Sources: IC 9-21-16-7; Driver handbook, Chapter 7: Parking and Reversing.

  • Right of way

A crossbuck stands alone at a railroad crossing, with no stop sign or lights. What does it mean?

Answer: Treat it as a yield sign. A crossbuck alone is treated as a yield sign. With a stop sign you must stop, and active bells, lights or gates require a stop until the warning ends.

Other choices: Speed up to clear the tracks. Racing a train is dangerous and illegal in practice. Stop completely every time. A full stop is required only with a stop sign or active warning.

Sources: IC 9-21-8-39; Driver handbook, Chapter 7: Safe Vehicle Operation.

  • Sharing the road

A pedestrian is in a crosswalk. What must the driver do?

Answer: Yield the right-of-way to the pedestrian. Drivers always yield to pedestrians in a crosswalk and should never turn in a way that makes a pedestrian stop, slow down or take other special action.

Other choices: Sound the horn and keep going. A horn does not give a driver the right to go. Speed up to clear the crosswalk first. Speeding up endangers the pedestrian.

Sources: IC 9-21-8-37; Driver handbook, Chapter 7: Pedestrian Safety.

  • Emergencies

You approach a stopped police car with its lights flashing on a four-lane highway. What should you do?

Answer: Change to a lane away from it if safe. Approaching a stopped emergency vehicle with flashing lights, change to a lane away from it if safe, or slow to at least 10 mph below the posted limit.

Other choices: Stop in your lane until the lights turn off. Stopping in a travel lane creates a hazard, and the rule asks for a lane change or slowing. Speed up to get past quickly. Passing faster shortens the time workers have and breaks the duty to slow or move over.

Sources: IC 9-21-8-35; Driver handbook, Chapter 7: Sharing the Road with Other Vehicles.

  • Turns and lanes

You realize you are about to miss your exit on the interstate. Which action is legal?

Answer: Drive on to the next exit and return from there. Never back up or turn around across the median to reach a missed exit. Continue to the next exit, since stopping on the shoulder is allowed only in an emergency.

Other choices: Cut across the grass median to turn around. Crossing the median is illegal except for emergency and maintenance vehicles. Stop on the shoulder and reverse to the exit. Backing up on the interstate is unsafe and illegal.

Sources: Driver handbook, Chapter 7: Safe Vehicle Operation.

  • Safe driving

Your car plunges into deep water and starts to float. What should you do?

Answer: Open a window and climb out. If a vehicle plunges into water, remove the seat belt, open a window, get children out, and climb to the roof. Do not try to open a door.

Other choices: Swim underneath through the trunk. A trunk is a sealed space, so swimming into it would trap you instead of freeing you. Open the door right away. Water pressure makes doors nearly impossible to open.
